1. What is Hieper?

Hieper is an online service provided by TOMMO Design, a sole proprietorship registered at Perzikstraat 10, 6543 ZB Nijmegen, the Netherlands, listed with the Dutch Chamber of Commerce under number 90258339.

Hieper helps you keep track of birthdays, organise parties, save gift ideas and create personal birthday messages. By creating an account or using Hieper, you agree to these terms and our privacy statement.

2. Your data, your responsibility

You are responsible for the accuracy of the data you enter into Hieper, or that is entered on your behalf via a shared circle. Hieper does not verify the substance of that data.

3. Reminders

Hieper does its best to remind you of birthdays on time. Reminders are an aid, not a guarantee. For important moments, do not rely on Hieper alone.

4. Hieper Plus

Hieper Plus costs EUR 19.99 per year or EUR 2.99 per month and automatically renews at the end of each period, unless you cancel. You can cancel at any time from Settings; you keep access until the end of the current period.

The free version may have limits, for example on the number of contacts, AI birthday messages or other Plus features.

Hieper may offer temporary promotions, such as a free Plus period when you share your Hieper link or Circle link and someone else uses that link to add a birthday. If no payment details are requested for such a promotion, no paid subscription will start afterwards. You then automatically fall back to Free.

5. Cancellation and end of the period

When you cancel Plus, the Plus features remain active until the end of the period you have paid for. After that you automatically return to the free version. No refund is given for the remaining period, except in the cases described below or required by law.

Under the Dutch Wet van Dam, a subscription that has been tacitly extended after the first annual period can be cancelled at any time with a notice period of no more than one month.

6. Right of withdrawal (14-day cooling-off period)

As a consumer you have a 14-day cooling-off period under Book 6 of the Dutch Civil Code (distance consumer contracts) after subscribing to Hieper Plus. Within this period you can rescind the agreement without giving any reason by emailing support@hieper.app. We will refund the full amount within 14 days.

Please note: Hieper Plus is a digital service. By expressly agreeing at checkout to immediate delivery and acknowledging that you thereby waive your right of withdrawal, the cooling-off period ends once the service has been delivered. If you do not do this, the 14-day cooling-off period continues to apply.

7. Conformity

We make sure Hieper Plus meets what you may reasonably expect from it. Is something not working as promised? Contact us at support@hieper.app; we will fix it or offer an appropriate solution in line with Book 7 of the Dutch Civil Code.

8. Misuse

You may not use Hieper's public forms for spam, inappropriate or unlawful content, or to add people's data without their knowledge in order to harass them. In case of misuse we may suspend your account.

9. Deleting your account

You can delete your account yourself via Settings, Delete account. We will then erase your data as far as technically possible and cancel any active subscription. Deleting during an ongoing Plus period does not entitle you to a refund of the remaining portion, unless you are within your statutory cooling-off period.

10. Liability

Hieper is an aid. We are not liable for missed birthdays, consequential damage or the content of messages you compose via Hieper. This limitation does not apply in case of intent or gross negligence and does not affect your mandatory consumer rights.

11. Governing law and complaints

These terms are governed by Dutch law. Do you have a complaint? Email support@hieper.app. We will respond within 14 days.

If we cannot resolve the matter together, you may submit the dispute to the competent Dutch court.
